Effective date: October 1, 2026
This Notice of Privacy Practices describes how FW Healthcare Services (“we,” “us,” or “our”), may use and disclose your protected health information (“PHI”) — information about you, including demographic information, that may identify you and relates to your past, present, or future physical or mental health or condition and related health care services.
Our Commitment
We are committed to protecting the privacy of your health information. We are required by law to maintain the privacy of your PHI, to provide you with this notice of our legal duties and privacy practices, and to notify you following a breach of unsecured PHI.
How We May Use and Disclose Your Health Information
The following categories describe the ways we may use and disclose your PHI without your written authorization:
- Treatment: We may use and disclose your PHI to provide, coordinate, or manage your health care — for example, sharing information with caregivers, physicians, or other providers involved in your care.
- Payment: We may use and disclose your PHI to obtain payment for services — for example, to bill you, an insurer, or another responsible party, including Medicaid or other payers.
- Health care operations: We may use and disclose your PHI for our business operations — such as quality assessment, staff training, accreditation, and compliance activities.
- Required by law: We may disclose your PHI when required by federal, state, or local law.
- Public health and safety: We may disclose your PHI to public health authorities, or to prevent or lessen a serious threat to health or safety.
- Health oversight and legal proceedings: We may disclose your PHI to health oversight agencies, or in response to a court order, subpoena, or other lawful process.
- Law enforcement and other authorized disclosures: We may disclose your PHI as permitted by law to law enforcement officials, coroners, medical examiners, or as otherwise authorized under HIPAA.
Any other use or disclosure of your PHI — including most uses of psychotherapy notes, uses for marketing, or sales of PHI — will be made only with your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already acted on it.
Your Rights Regarding Your Health Information
You have the following rights with respect to your PHI:
- Right to access: You have the right to inspect and obtain a copy of your PHI in our designated record set. We may charge a reasonable, cost-based fee for copies.
- Right to request amendment: If you believe your PHI is incorrect or incomplete, you may ask us to amend it. We may deny your request in certain circumstances, but we will explain our decision in writing.
- Right to request restrictions: You may ask us not to use or disclose certain PHI for treatment, payment, or operations. We are not required to agree, except when you request that we not disclose PHI to a health plan for services you paid for in full out of pocket.
- Right to confidential communications: You may request that we communicate with you about health matters in a certain way or at a certain location, and we will accommodate reasonable requests.
- Right to an accounting of disclosures: You have the right to request a list of certain disclosures of your PHI made during the six years before your request.
- Right to a paper copy: You have the right to obtain a paper copy of this notice at any time, even if you received it electronically.
To exercise any of these rights, contact us using the information below and submit your request in writing.
How to File a Complaint
If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the U.S. Department of Health and Human Services. You will not be penalized or retaliated against for filing a complaint.
